Written evidence submitted by the Ministry of Justice

The CJSS team within MoJ has provided data in relation to prosecutions under the Uniforms Act 1894. Data on a number of other offences was requested but was either not held or not held in a form that allowed the types of offence requested to be distinguished.

I understand that the data and the accompanying explanations provided about unavailable data will be put into written evidence by the Defence Committee. If the evidence is agreed it will be put into the public domain.

Please find a table concerning section 2 of the Uniforms Act 1894 from 2011 to 2015 below.

The reasons for being unable to provide data for the others are being summarised below:-

There was no data (i.e. nil figures) on the Army or Air Force Act, and specific offences have not been created that pertain to the relevant sections of the Naval Discipline or Armed Forces Acts. Further, Fraud data held by the Ministry of Justice is not available at the level of detail requested. That level of data is only available in the case files at the courts which heard the cases.

As previously discussed, some of the data you seek will actually be available from the Ministry of Defence via Court Martial data.
