Written Evidence from KC Wong FRSA FCollT (HKG0003)

 

Introduction:
 

           I. Since Hong Kong has been occupied by the PRC in 1997, the whole system has been corrupted and damaged. The British-Sino Joint Declaration's “One Country, two systems” was completely failed. It is because the PRC is always a liar.


          II. Being an ex-residence of the British Hong Kong, I feel I am responsible to speak out the real situation of Hong Kong in recent and seek the UK GOV to take any action, including either take back the Territory or help her to be independence, once after the international treaty has broken and invalid.
 

          III. The following are evidences which show the implementation of 'One country, Two systems” is completely failed:

 

  1. Immigration policy

1.1 Nowadays the Hong Kong Immigration Department cannot fully control the border and the issuing of visas, especially the visas of Chinese. For example, The tourist visa for the Chinese tourists, which is called “Exit-Entry Permit for Travelling to and from Hong Kong and Macao “ is not issued by the Hong Kong Immigration Department, instead it is issued by the China Public Security Bureau Office.

1.2 The impact of this policy is the Hong Kong Immigration Department cannot control who can visit Hong Kong and who will come to Hong Kong. The border officers have to let them come in after they have shown the “Exit-Entry Permit for Travelling to and from Hong Kong and Macao “, which is not issued by the Hong Kong government. And these Chinese people hasve damaged the daily life of the Hong Kong Citizens,  for example: The problems of:
 

- the City's hygiene (for an example: They poo or pee in the Hong Kong's underground (https://www.facebook.com/photo.php?v=450114191795280&fref=nf)
- Over population

- Occupy the public resources such as the transportation system
-  A serious inflation, the surge of rent which causes a lots of local shops have to close down and subsided by the luxury shops and RX shops which mainly serve the Chinese.
-  The problem of smugglers in the border. The Hong Kong travelling visa for Shenzhen residence allows them in and out Hong Kong unlimited times during the effective period of the visa permit, which is not issued by the Hong Kong Immigration Department.
-  Security issue, the crime rate which is involved by the Chinese is obviously increased. 

1.3 The other issue is the “One-way Permits (OWPs) from the Public Security Bureau Offices of China”. This type of Permit allows the Chinese people immigrate to Hong Kong, without the control and approval from the Hong Kong Immigration Department. Again, many Chinese who have no connection with Hong Kong, in any types, are being issued such “One-way Permits (OWPs)”, many of them are the corrupted Chinese government officials, but the Hong Kong Immigration Department cannot control them to reside in Hong Kong.
 



1.4 This phenomenon has already conflicted with:

No. 3(2)   – Immigration policy of Hong Kong is not part of “foreign and defence affairs “
No. 3(5)   – Because of the huge amount of Chinese flush into Hong Kong, “The current social and economic systems in Hong Kong will remain unchanged, the life-style “ becomes invalid.

No. 3(10)  –  All visas and permits for Chinese people come into Hong Kong are not issued by the Hong Kong Immigration Department, “The Government of the Hong Kong Special Administrative Region may on its own issue travel documents for entry into and exit from Hong Kong” becomes invalid.
 

  1. Education policy
    2.1 In order to brain wash the children in Hong Kong, plus fade out the race of HongKongese, the Education Department of  Hong Kong is trying to fade out the mother language and culture of HongKongese – Cantonese, by using Mandarin as the teaching language in the Chinese language lesson. This never happened before 1997: Cantonese always is used as a teaching language in the Chinese language lesson, and Mandarin is another separated subject.. This phenomenon completely conflicts with the British-Sino joint Declaration No. 3(5):

    “The current social and economic systems in Hong Kong will remain unchanged, and so will the life-style The current social and economic systems in Hong Kong will remain unchanged, and so will the life-style “

    2.2 Besides the Hong Kong's mother language and culture erosion by the PRC controlled Hong Kong Government, they also implement the National Education by brain washing students with false and distort information; even the children in nurseries are being forced to sing the PRC anthem and play dramas which praise the Chinese Communist Party, plus have to attend the brain washing lessons with textbooks.Again these never happened before 1997, who still will say “social and life-style remain unchanged”?

    2.3 For the Further education, the Hong Kong government has abandoned the HKCEE in Form 5 and A-level in Form 7 by implementing the DSE  after students has finished a 6-year secondary education. The DSE system only satisfies  compatile with the PRC's “High level” secondary education, in order to allow Chinese students have an easier entry. It is because under the British Hong Kong system, the Higher education did only last for 3 years; but now Hong Kong has changed to 4 years, which is same as the system of the PRC.

    2.4 For  the Higher education,  The PRC controlled Hong Kong government has reserved up to 305 undergraduate programme seats for the Chinese students, by using the name of “international students” to cheat the outsiders; for postgraduate programmes, the Chinese have occupied 70% of the seats.





    2.5 Again this never happened before 1997; the Hong Kong government, under the control of the PRC, never gives priority  to the HongKongese; many Hong Kong students who have met the entry requirement but cannot enter the university; many university graduates who are the citizens of Hong Kong cannot continue their postgraduate study because most of the seats are being occupied by Chinese; instead, the Hong Kong government uses the Hong Kong taxpayers' money to subside the Chinese students, many of them even enjoy a full bursaries.
     
  2. Justice and Hong Kong security

    3.1 After 1997, the system of justice has completely corrupted. There are many cases as evidence: Wu Sin, the chairperson of Sing Tao Post  just after 1997, who is a Pro-Chinese, was judged innocent in a asset blenching case, even with convincing evidences; in contrast Leung Kwok Hung, the LegCo member who was sent to jail for few weeks because of a protest. These show the courts of Hong Kong cannot operate independently with justice. Also many Pro-Chinese organisations will not be charged after they have broken the law of Hong Kong again and again, by taking violence actions in public; but over 500 Hong Kong citizens were arrested in 2nd July, 2014 because they have joined the peaceful protest: The occupation in Charter Road, Central.


3.2 Here is an example: Billy Chiu, a member of an organisation “I am HongKongese , but not Chinese”, who is fighting for Hong Kong independence, including tried to enter the Prince of Wales Building which now is the PLA headquarter in Central, shouted to the PLA they should leave Hong Kong because they are “bloody”, with showing the British Hong Kong flag, was being intimated by a gang, who are always appear in the Pro-Chinese organisation's protest. Even have video evidence, the Hong Kong police still have no action until now, this already shows they cannot keep going to be political neutral.

3.3 Another case: the Pro-Chinese organisation - “Help Hong Kong to Speak”, which the leader is Chow Yung, who claimed himself has the abode right of the UK, his members (black and white shirt) took violence action to the HongKongese (blue shirt), but the government officials (white shirt with walkie talkie), took no action, again.

3.4 In recent Leung Oi See,  the vice chairperson of the PRC's Basic Law Committee, claimed that all judges of Hong Kong have to “love the PRC”. Her speech was being rebounded by the judicial officers. The action of this PRC representative has completely destroyed the 3(2) and 3(3) section of the Joint Declaration.

  1. Public elections

    4.1 In the recent political reform issue, the PRC government and her officials are completely involved the consultation. Again they have completely violated the No.3(4) of the Joint Declaration:

    “The chief executive will be appointed by the Central People's Government on the basis of the results of elections or consultations to be held locally “


4.2 Note that all PRC officials are not local inhabitants of Hong Kong.

4.3 Because the involvement of the PRC officials , the Hong Kong government ignores most local inhabitants' opinion : The CE candidates can be nominated by the Hong Kong citizens. This also breaks No. 3(2) of the Joint Declaration:

“ The Hong Kong Special Administrative Region will enjoy a high degree of autonomy, except in foreign and defence affairs which are the responsibilities of the Central People's Government.”
 

  1. Economics and finance

    5.1 The PRC also involves to order the major banks on some issues. The most famous was including the HSBC and Standard Chartered Bank, has pull out the whole year advertisements in the last minute which have confirmed and contracted with the Apple Daily Hong Kong; if they don't follow their business in the PRC will be affected. The intervention of the PRC officials again has violated  the No. 3(2) and 3(5) of the declaration: The PRC officials have no rights to effect any decision which is made by any international financial co-operations' Hong Kong branch by using their business in the PRC as a “bargaining chip”, which is very dirty and dangerous, even the local government has no rights to do so.

    Conclusion and suggestion:

    1. The whole situation of Hong Kong has been changed negatively, which no longer keeps going to be the same as during the British rule.

    2. With evidences above, at least we can see the No.3(5) of the Joint Declaration has been completely destroyed, the rest of the treaty will also being corrupted rapidly. As there were some news and intelligence show that the PLA will involve once the “occupy Central” movement becomes the true, I can foresee the PRC will break the No. 3(11) also in the near future.

    3. The UK GOV must prepare to take action, either take back the Territory or help her to be independent. As the PRC only has order and control, and she has zero experience on public election and democracy, we all should not put any hope to the PRC who will implement a true public election and give a true democracy to Hong Kong, as she won't and has no ability to do that.

    4. In Hong Kong there are 3.5 million of British National (Overseas), as the situation is getting worse and unclear, the UK GOV should give the children whose both parents are holding a valid BN(O) passport an Overseas British Nationality . It is because not only the inheritance of their parents' nationality is the basic human rights, but also the UK GOV should protect them once Hong Kong has any incident.

    5. Once the situation has come to the worse, e.g the PRC army has occupied Hong Kong due to the occupy Central movement, the UK GOV and the Commonwealth should send troops to protect and retake the Territory. It is because at that moment the Treaty is confirmed to be broken, but also the Territory is living 3.5M of British Nationals.
