Call for evidence on the reform of the Gender Recognition Act 2004

Do the proposed changes make the process kinder and more straightforward?

Moving the process to be solely online may help some individuals, but may exclude other individuals who do not have easy access to the internet.

Should the current fee be removed or retained?

Any fee required by the government should cover the costs involved in maintaining the service, and only that cost. This was recognised in Companies House fees many years ago. I don’t know if the cost is £140, or higher or lower, but whatever the cost is, the fee should cover it.

Should the requirement for a diagnosis of gender dysphoria be removed?

A decision made by individuals has effects beyond the individuals themselves.  There is evidence that the brain continues to mature and change into the early twenties. On these grounds it is better for the individual and wider society for the feelings of being in the wrong body to be recognised by professionals. I would recommend that the need for a diagnosis be retained.

Should the requirement for individuals to live in their acquired gender for two years be retained?

On the grounds mentioned above, this requirement should be retained to help the individual be sure that they are sure that they wish to change. There have been several cases where individuals have later regretted changing gender.

Should the requirement for spousal consent be changed?

Parties to a marriage make a commitment to one another jointly.  One party to the marriage should not be able to unilaterally decide to change gender. This needs to be carefully thought through by both parties before any action is taken.

Should the age at which people can apply for a GRC be lowered?

As the brain continues to develop into the twenties, then the complete person may not appear until later than the age limit of 18. It should not be lowered, but consideration should be given to raising the age limit.
