Supplementary written evidence submitted by The National Crime Agency (NCA),
relating to Policing and Security in Northern Ireland inquiry
[PSNI0031]

I write further to my oral evidence session on 11th March 2026.

During the session the committee asked whether it was possible for the signatories of the General Authorisation to amend or withdraw from that agreement. I committed to providing a written response to that question.

The General Authorisation between the Department of Justice for Northern Ireland and the Director General of the National Crime Agency sets out the requirements and conditions for designated NCA officers to exercise the powers and privileges of a Northern Ireland Constable.

In relation to the matter of whether a party can amend or withdraw from the General Authorisation, the relevant section states that parties to the agreement may review the agreement at any time. Parties to that agreement are the Minister of Justice for Northern Ireland and the Director General of the NCA. Additionally, the Chief Constable of PSNI has a right under the agreement to request a review of the General Authorisation.

There is no automatic or express right of withdrawal from the agreement after a specified process. However, parties to the agreement and the Chief Constable of PSNI could request a review opportunity with the intention of amending or terminating the agreement.

Further, the General Authorisation once agreed remains in force for a period of five years. If a further agreement is not made, the agreement will end until such time as a new General Authorisation is agreed.
