MPs scrutinise review of Human Rights Act

The Justice Committee question Sir Peter Gross QC, who was the Chair of the independent review of the UK’s Human Rights Act.
Purpose of the session
The Independent Review made a number of recommendations to Government on how the Act should be updated. The session will explore these recommendations and the extent to which they are reflected in the Government’s proposals to replace the Act with a Bill of Rights, which were published alongside the Independent Review in December.
MPs will examine the case for changing the UK’s Human Rights Act and look at the areas that the Government are focused on reforming. Questions are likely on the Review’s recommendation to amend section 2 of the Human Rights Act so that the courts consider UK legislation and case law before looking to the case law of the European Court of Human Rights, following concern in the Review that the courts have given “insufficient prominence” to UK statute, common law and case law in its interpretation of the Act. The session will also investigate the Review’s analysis of the Act’s impact on the relationship between the judiciary, the executive and the legislature.
