Withdrawal Agreement Bill: call for evidence

Following the passage of the European Union (Withdrawal) Act 2018 and the establishment of the European Statutory Instruments Committee, the Procedure Committee's inquiry into Exiting the European Union: scrutiny of delegated legislation is examining other proposed legislation with implications for the procedures of the House of Commons.

On Wednesday 10 October the Procedure Committee takes oral evidence from Ministers at the Department for Exiting the European Union on the Government's White Paper Legislating for the Withdrawal Agreement (Cm 9674), published on 24 July, and on the prospective European Union (Withdrawal Agreement) Bill.

Call for submissions

In advance of that session the Committee is calling for written submissions on relevant issues arising from the White Paper, including:

  • the nature and extent of the delegated powers the Government is likely to be required to claim in the Withdrawal Agreement Bill, in the event a withdrawal agreement is reached and approved by the House of Commons
  • the appropriate level of parliamentary control over the exercise of such powers
  • whether instruments to be made under such powers ought to be subject to sifting by the European Statutory Instruments Committee
  • the time constraints which the exit timetable imposes on the exercise of such powers
  • whether there is likely to be any justifiable requirement for an urgency procedure for the exercise of such powers

Any other observations on the White Paper and the prospective Bill which are relevant to the Committee's remit and its work in this inquiry are invited.

Deadline for submissions to this stage of the inquiry to be taken into account for the 10 October evidence session is 5.00 pm on Tuesday 2 October 2018. Early submissions are very welcome.
